ANJ Issues Record Fine to Unibet for Self-Exclusion Failure
The Autorité Nationale des Jeux (ANJ), France’s gambling regulator, has imposed a historic EUR 800,000 fine on SPS Betting, the operator of the Unibet brand in France, for a serious self-exclusion oversight. This penalty is the largest ever issued by the authority, underscoring the gravity of the situation.
The ANJ’s Largest Fine Yet
According to the ANJ, the Unibet platform experienced a significant malfunction related to self-exclusion, which persisted for an extended period. This flaw allowed self-excluded individuals to continue placing bets, potentially putting vulnerable customers at risk of gambling-related harm.
The issue, affecting only iOS users, spanned nearly two years, starting in March 2021 and lasting until December 2022 before being rectified by Unibet. However, it resurfaced for about three more months before additional corrective actions were taken to resolve the matter.
While the exact number of self-excluded players who utilized the betting services due to the malfunction remains unconfirmed, estimations suggest it may not exceed 100 players. SPS Betting indicated that over 4,500 player accounts were affected by the issue, regardless of whether bets were placed. ANJ, on the other hand, cited a figure of 6,754.
Severe Violation and Consequences
Given the severe nature of the violations, the prolonged duration of the malfunction, and the inefficacy of initial remediation efforts, the ANJ opted to levy its largest fine to date. The regulator stressed the importance of respecting self-exclusion in regulated online gambling, considering it a fundamental aspect.
Another contributing factor to the hefty fine was Unibet’s previous sanctions in France. The most recent penalty stemmed from breaching the country’s return to player (RTP) limit of 85%.
Unibet has a two-month window to contest the decision and is mandated to prominently display information about the penalty on its homepage.
Unibet’s Challenges and France’s Market Changes
Unibet faced scrutiny in the Netherlands in January for attempting to block lawsuits from former players who lost money before the company became regulated in the country. Such legal actions have become more common in regulated markets, despite operators’ attempts to deter them.
Meanwhile, France’s gaming industry experienced a tax increase on select products recently. Although the country initially considered abandoning the plan for higher gambling taxes, it ultimately reintroduced the measure in its latest budget.
