Kalshi Challenges Cease-and-Desist Orders from Nevada and New Jersey Gaming Boards
Kalshi, a regulated financial exchange and prediction market platform that allows users to trade on real-world event outcomes, is currently seeking injunctive relief from cease-and-desist orders issued by the Nevada and New Jersey gaming boards. The Nevada Gaming Control Board (NGCB) sent a notice to Kalshi in early March, instructing the company to halt its sports event contracts in the state by March 14.
Similarly, the New Jersey Division of Gaming Enforcement (DGE) issued a cease-and-desist letter to Kalshi and Robinhood on March 27, giving them until March 29 to remove their sports event contract markets from New Jersey.
Nevada Lawsuit Alleges NGCB Violated CEA
While Robinhood complied with the cease-and-desist order, Kalshi decided to challenge both states. The lawsuit against Nevada argues that the NGCB violated the Commodity Exchange Act (CEA). Despite being federally regulated by the Commodity Futures Trading Commission (CFTC), Kalshi claims it is not subject to state-level monitoring.
“The Commodity Exchange Act explicitly grants ‘exclusive’ authority to oversee, approve, and regulate futures trading on registered exchanges to a federal agency – the CFTC,” Kalshi stated in the lawsuit.
The lawsuit also contends that allowing individual states to enforce their own regulations would create the regulatory uncertainty that Congress sought to avoid.
Kalshi, Robinhood Potentially Violated New Jersey’s Constitution
In addition to the federal regulations, Kalshi and Robinhood are accused of violating New Jersey’s constitution by offering event trading on college sports. New Jersey laws prohibit betting on college teams.
Kalshi’s Co-Founder and CEO, Tarek Mansour, defended the company on social media, stating that the cease-and-desist orders demonstrate a lack of understanding of prediction markets and undermine the foundation of the U.S. financial markets.
