SWC Urges CFTC to Halt Sports Event Contracts in Tennessee
The Tennessee Sports Wagering Council (SWC) has taken a firm stance against the offering of sports event contracts in the Volunteer State. In a letter addressed to the Commodity Futures Trading Commission (CFTC), the SWC urged the federal agency to “not permit” the trading of sports event contracts in Tennessee.
States Take Action
The SWC’s initiative comes after Illinois, Maryland, Montana, Nevada, New Jersey, and Ohio sent cease-and-desist letters to trading platforms Kalshi and Robinhood. Additionally, Michigan launched investigations into similar markets last week. The issue has escalated to judicial phases in Nevada and New Jersey.
SWC’s Letter to CFTC
Executive Director Mary Beth Thomas signed the SWC’s two-page letter to CFTC Acting Chair Caroline Pham. The letter outlines 13 alleged violations of state laws and regulations from prediction markets that offer sports event contracts. The Tennessee Sports Gambling Act clearly defines what constitutes a “wager” in the state.
The Act states that a wager is “a sum of money that is risked by a bettor on the unknown outcome of one or more sporting events.” The SWC emphasized that any entity accepting wagers on sporting events without a valid license issued by the council is in violation of the Act.
Protecting Tennessee’s Wagerers
The SWC highlighted the various requirements set forth by Tennessee legislators to protect individuals who choose to wager in the state. These include restrictions on individuals under the age of 21 from wagering, lists of ineligible persons or categories, responsible gambling measures like self-exclusion, and prohibitions on using credit cards and cryptocurrency to fund accounts.
Furthermore, regulations do not permit kiosks for establishing or accessing accounts, and specific anti-money laundering controls are in place. The Act also prohibits wagering on injuries, penalties, or actions of college athletes, as well as in-game prop bets on college teams.
Non-Compliance Concerns
The SWC raised concerns that the “CFTC regulated entities” offering sports event contracts are not in compliance with the protections mandated by the Tennessee Legislature. The council is urging the CFTC to take action to ensure that these entities adhere to the state’s regulations to safeguard individuals participating in sports wagering activities in Tennessee.
